Manufacturer Warranty

MANUFACTURER WARRANTY TERMS AND CONDITIONS:

The following terms apply to the New Tire Limited Warranty, the Limited Mileage Warranty, and the Road Hazard Limited Warranty (“the Warranties”).

1. Who gets the Warranties: the Warranties apply to the original purchaser (“you”) and may not be assigned, including to a subsequent purchaser or owner of any applicable motor vehicle. A tire(s) mounted on any vehicle other than the vehicle on which it was first mounted is not covered.

2. Where to go for replacement and/or service: the Warranties will be honored at all locations owned by Mavis Tire Supply, including the location on the front of this document (“this Mavis Tire Supply location”). See complete store address list at mavistire.com. To obtain warranty service, you must present your sales invoice/receipt and service record, along with the unserviceable tire(s). You may also contact our CUSTOMER SERVICE OFFICE at (800) 757-4291.

3. Consumer rights: This warranty gives you specific legal rights, and you may have other rights that vary from state to state.

4. Conditions & exclusions: Nothing in this warranty is intended as a representation that tire failure cannot occur. To the extent permitted by law, liability for consequential damages is disclaimed, and the durations of implied warranties (if any) are limited to the duration of the express warranties herein.

5. Your obligations: it is your obligation to properly maintain your tires by ensuring that, among other things, (1) tires are operated at the manufacturer’s recommended cool inflation pressures; (2) tire and wheel assemblies are in balance; (3) tires are rotated on a regular basis (every 5,000 miles is recommended); (4) vehicle is in proper wheel alignment; and (5) vehicle steering, suspension, and drive-line components are well maintained (collectively, “Proper Tire Care”). Any Mavis Tire Supply location, including this location, will check and inspect tire condition, wheel alignment, and vehicle condition at any time without charge.

6. Tread depth: for purposes of the Warranties, tread depth is measured vertically from the top of the tire’s rubber to the bottom of the tire’s deepest grooves in increments of 32nds of an inch. A tire’s remaining tread depth is considered “usable tread depth” until the depth measures less than 2/32nd of an inch.

NEW TIRE LIMITED WARRANTY:


What is covered and for how long:

This Mavis Tire Supply location warrants that your tire will not become unserviceable due to a defect in materials or workmanship. The warranty expires when the tire no longer has usable tread depth. If the tire becomes unserviceable due to a defect in material or workmanship, you will receive a replacement tire at a price determined according to the terms and conditions below.

Price determination:

The amount you will pay for a replacement tire is calculated by multiplying the percentage of wear by the original purchase price. Please see the below graphic (“Percentage of Wear Graphic”) for a representation of how the price is calculated:

What is not covered:

This warranty does not cover tires that become unserviceable due to tire uniformity complaints after the first 2/32nds of an inch of tread wear. This warranty also does not cover tires that become unserviceable due to conditions resulting from: (1) road hazards, such as cuts, snags, punctures, or impact breaks; (2) improper installation, wheel misalignment, or tire/wheel assembly imbalance; (3) consumer damage (such as failing to uphold Proper Tire Care and vehicle maintenance), misuse, abuse, or accidents; or (4) commercial use of the tires.

LIMITED MILEAGE (TREADWEAR) WARRANTY:

What is covered and for how long:

If this warranty is included on the receipt for your purchase, this Mavis Tire Supply location warrants that, with Proper Tire Care, your tire(s) will attain the mileage specified on your purchase receipt. If such tire does not attain the specified mileage figure, then you will receive a pro-rata credit according to the terms below.

Credit determination:

The pro-rata credit is calculated by multiplying the percentage of mileage not attained by the original purchase price. This credit will be deducted from the current selling price of the replacement tire.

What is not covered:

1. Defects in workmanship and/or materials.

2. Failures caused by road hazards, such as cuts, snags, punctures, or impact breaks.

3. Tires used on special applications, such as light trucks (unless specifically covered according to the purchase receipt), vans, recreational vehicles or commercial vehicles including taxi, police, etc.

4. Damage due to failure to uphold Proper Tire Care.

5. Tires damaged by fires, wrecks, obstructions on the vehicle, or willful and malicious damage.

6. Repairable punctures or tires run flat.

7. Sidewall damage from scuffing curbs or other cosmetic damage.

8. Tires transferred from the vehicle on which they were originally installed.

9. Any commercial use of the tires.

10. Dealer services, such as mounting and balancing, and applicable state and federal (FET) taxes.

ROAD HAZARD LIMITED WARRANTY:

What is covered and for how long:

If this warranty is included on the receipt for your purchase, then this Mavis Tire Supply location warrants that if a tire becomes unserviceable as a result of road hazards (e.g., cuts, snags, bruises, impact breaks, or other un-repairable punctures), consumers are entitled to a replacement tire at a cost calculated according to the terms below. The duration of this warranty is the shorter of (1) 3 years from the purchase date or (2) until the given tire retains less than 2/32nds of an inch of tread depth.

Replacement tire price determination:

The amount you will pay for a replacement tire is calculated by multiplying the percentage of wear by the original purchase price. Please see the Percentage of Wear Graphic (above) for a representation of how the price is calculated.

What is not covered:

1. Damage due to failure to uphold Proper Tire Care.

2. Tires with sidewall damage from scuffing curbs or other cosmetic damage.

3. Tires removed from service due to being overloaded or intentional abuse.

4. Tires that can safely be fixed.

5. Road service, towing costs, and other incidental damage.

6. Dealer services, such as mounting and balancing, and applicable state and federal (FET) taxes.

UNCLAIMED VEHICLES: If you do not pay for service and claim your vehicle promptly following completion of service, this Mavis Tire Supply location may exercise all remedies permitted by law, including (without limitation) towing of your vehicle from our property after 30 days following completion of service.
